Legal Forwarder (Full Time)

Location: Bedford Heights, OH  Country: United States of America
 

The McCarthy, Burgess & Wolff, Inc. (MBW) Legal Forwarder is responsible for reviewing accounts and providing information to clients regarding the viability of pursuing litigation. The Legal Forward also oversees clients accounts bonded to outside attorneys for litigation treatment, monitors the work performed by outside attorneys, and reports results of litigation to the clients.

Essential Job Functions
Oversees assigned client, law firm or group of accounts.
Researches legal status accounts regarding assets and garnishments.
Negotiates and approves payment arrangements or settlement offers in accordance with company guidelines on legal status accounts.
Manages attorneys assigned to legal accounts and ensures attorneys are aggressively pursuing the accounts, post judgment remedies, and reporting accordingly.
Coordinates the legal strategy between the client and the attorney.
Identifies problem accounts or problem attorneys and escalates to In-House Attorney if issue is not resolved.
Functions as intermediary between customers who wish to attempt to negotiate a claim once placed with an attorney and the attorney.
Oversees timely remittance of funds collected by the attorney.
Manages assigned file in the legal department, and monitors those accounts in pre-legal, including participation in discussions with the client, collector, and/or sales person.
Investigates cases
Obtains affidavits and organizes depositions.
Reads, comprehends and adheres to the Fair Debt Collections Practices Act (FDCPA).
Reads, comprehends, adheres to, and enforces any and all applicable ISO policies.

Job Requirements

Knowledge: Must have comprehensive knowledge and experience in collections, skip-tracing, and compliance;, FCRA, FDCPA, HIPAA, and Microsoft Outlook. Comprehensive grasp of all collection laws, both federal and state.

Experience: At least 2 years experience working collection litigation or civil litigation files

Skills/Aptitudes: Good computer skills and proficiency with word processing and spreadsheet software programs are required. Must know and understand the rules of civil procedure and have a working knowledge of the civil litigation process.

Interpersonal Skills: Ability to multi-task, prioritize demands, take initiative, work proactively and be resourceful; outstanding interpersonal skills with the ability to work both independently and collaboratively with a diverse set of personalities and a strong client focus; and self-starter with a desire to grow/learn. Proven ability to lead, teach, and persuade others while interacting effectively in difficult situations; must be able to achieve company objectives
